Acceptable Use Policy

1. Purpose

This AUP establishes prohibited and restricted uses of the Services and applies to Customer and Authorised Users.

2. Lawful Use

Use the Services in compliance with Applicable Law. Do not use them to facilitate unlawful conduct, fraud, unlawful surveillance, abuse, or material third-party rights violations.

3. Security

Do not bypass authentication or security controls, attempt unauthorised access, introduce malware, interfere with the Services, or misuse credentials.

4. Data and Privacy

Customer must have the rights and legal basis necessary to provide Customer Data and configure monitoring and other Personal Data processing features within the Services.

5. Fleet Operations Use

Fleet, driver and vehicle-management functionality must be used for legitimate operational purposes and in accordance with applicable privacy, employment and regulatory requirements. Customer bears sole responsibility for compliance.

6. Enforcement

Wowmotive may suspend, limit, or terminate access to the Services immediately and without liability for any actual or reasonably suspected material violation of this AUP, or where reasonably necessary to protect the Services, Customer Data, third-party systems, other customers, Wowmotive’s legal compliance, or Wowmotive’s reputation, subject to the MSA. Wowmotive may also disable, suspend, or limit a specific integration where necessary for the same reasons.

6A. Prohibited Reliance and High-Risk Use

Customer must not use the Services as an emergency response system, life-safety system, collision-avoidance system, sole source for legally required records, or sole source for transportation, employment, safety or regulatory decisions.

6B. Third-Party Services and Integrations

Customer must not represent that Wowmotive operates, owns, certifies, licenses, approves or guarantees an independent Third-Party Service merely because it is accessible through Wowmotive. Customer must comply with applicable third-party terms.

6C. Unlawful Monitoring

Customer must not use driver monitoring or tracking functionality for unlawful surveillance, stalking, harassment, discriminatory monitoring, or any purpose prohibited by law.

6D. Sanctions and Export Compliance

Customer must not use the Services in violation of applicable U.S. sanctions, export-control laws, or other trade restrictions.

7. Changes

Wowmotive may modify, update, or replace this AUP at any time, at its sole discretion and without prior notice, effective immediately upon posting the updated version, provided that no AUP update may override the DPA, the Security Addendum, negotiated commercial terms, liability provisions, or mandatory law. A change to any of those other documents or terms remains subject to the MSA’s amendment and version-control provisions, not to this Section. Where a change to this AUP is legally required to be separately notified or consented to, Wowmotive will provide the additional notice required by Applicable Law.

8. Incorporation

This AUP becomes binding when incorporated into an executed Order Form or other written agreement.
